What these cover
These terms govern hiring the audiovisual services of [PENDENT: nom o raó social] (NIF [PENDENT: NIF], Espanya). They form part of any accepted quote, unless the quote expressly says otherwise.
The services
Services are described in each quote: what gets filmed, with what equipment, how many pieces are delivered, in which formats and by when. The quote prevails over this document on anything it specifies.
Quotes and acceptance
- Quotes are valid for the period stated on them; if none is stated, 30 days.
- They are accepted in writing, email included.
- Once accepted, the date is held in the diary.
Prices and payment
- Prices are quoted excluding VAT unless stated otherwise, with the applicable tax added.
- Where the client is a business or professional, the invoice carries the income tax withholding required by Spanish law.
- Unless agreed otherwise, a deposit is due on acceptance and the balance on delivery.
- Payment terms are those stated on the invoice.
Delivery
Pieces are delivered by the agreed means and in the agreed formats. Deadlines run from the moment all necessary material and information have been received.
A copy of the material is kept for the period stated in the quote; after that, keeping the originals is not guaranteed.
Usage rights
This is the clause that prevents the most disputes, so it is spelled out:
- Authorship of the pieces belongs to [PENDENT: nom o raó social], as intellectual property law provides.
- The client receives the usage rights set out in the quote: for which uses, in which media, in which territory and for how long.
- Uses not covered by the quote — paid advertising, transfer to third parties, commercial exploitation — are agreed separately.
- Unless agreed otherwise, [PENDENT: nom o raó social] may show the piece in the portfolio and on social channels.
- The client warrants that they hold the rights to everything they supply (music, trademarks, images of other people) and to the image rights of anyone appearing.
Cancellations and date changes
- If the client cancels, the deposit covers holding the date and work already done.
- A live performance does not happen twice. If the show or event is cancelled for reasons outside anyone's control, an alternative date is found at no extra cost, subject to availability.
- If [PENDENT: nom o raó social] cancels through force majeure, the deposit is refunded in full or a new date is agreed.
Right of withdrawal
If you are hiring as a consumer — that is, outside a professional activity — you have 14 calendar days to withdraw without giving a reason, under Spanish consumer law.
This right does not apply to services already performed with your express consent, nor to content made to your specifications.

Liability
Liability covers proper performance of the agreed service. It does not extend to indirect damages, loss of profit, or problems arising from material supplied by the client or from venue conditions that were not disclosed in advance.
Data protection
Data provided in order to hire is processed according to the privacy policy.
Governing law
These terms are governed by Spanish law. For any dispute, the parties submit [PENDENT: jurisdicció].
